Terms of Service

By creating an account, accessing, or using the Dastyar platform, you agree to:

• Be bound by these Terms of Service in their entirety
• Comply with all applicable laws and regulations
• Be at least 18 years of age or have legal parental/guardian consent
• Have the legal authority to enter into this agreement

If you are using Dastyar on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms, and the terms 'you' and 'your' will refer to that entity.

Platform Access:

• Dastyar provides a platform for creating, training, and deploying AI assistants
• Services include assistant creation, knowledge base management, platform integration, and analytics
• Access to features depends on your subscription plan

Platform Integrations:

• Integration with messaging platforms including Telegram, Bale, and WhatsApp
• Website integration via widget or API
• Third-party integrations as available in the platform

Service Modifications:

• We reserve the right to modify, suspend, or discontinue any part of our services
• We may introduce new features, change existing functionality, or remove features
• Material changes will be communicated to users in advance when possible

Account Responsibilities:

• Maintaining the confidentiality of your account credentials
• All activities occurring under your account are your responsibility
• Notifying us immediately of any unauthorized use of your account

Prohibited Content:

• Content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Content that infringes intellectual property rights
• Content that promotes discrimination, bigotry, racism, or harm against any group or individual
• Content containing malware, viruses, or destructive code

Prohibited Activities:

• Using the service for any illegal purpose
• Attempting to gain unauthorized access to our systems
• Interfering with or disrupting the integrity of the service
• Scraping or harvesting information from the platform
• Using the service to spam or harass others
• Impersonating another person or entity

Our Intellectual Property:

• The Dastyar platform, including its software, design, text, graphics, logos, and other content is owned by us
• Our trademarks, service marks, and logos are protected by law
• We grant you a limited, non-exclusive, non-transferable license to use our platform for its intended purpose

Your Content:

• You retain ownership of content you provide to the platform
• You grant us a worldwide, royalty-free license to use, reproduce, and display your content for providing and improving our services
• You represent that you have all necessary rights to the content you provide

Feedback:

• If you provide suggestions or feedback, we may use this without obligation to you
• We appreciate your feedback to improve our services

Service Availability:

• We strive for high availability but do not guarantee uninterrupted service
• We are not responsible for service interruptions due to factors beyond our control
• Scheduled maintenance will be communicated in advance when possible

AI Limitations:

• AI assistants may not always provide accurate or complete information
• You are responsible for reviewing and verifying AI-generated responses
• AI performance depends on the quality of training data you provide

Disclaimers:

• Services are provided 'as is' without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We do not warrant that the service will meet your requirements or be error-free

Subscription Plans:

• We offer various subscription plans with different features and limitations
• Free plans may be available with limited functionality
• Paid subscriptions are billed according to the plan you select

Payment Terms:

• Payments are due in advance for the subscription period
• All fees are non-refundable unless required by law
• We may change our fees with 30 days notice before the next billing cycle

Subscription Management:

• You may upgrade, downgrade, or cancel your subscription through your account settings
• Cancellations take effect at the end of the current billing period
• Downgrading may result in loss of features or data

Termination by You:

• You may terminate your account at any time through your account settings
• Upon termination, you will lose access to all services and features
• Your data will be handled according to our Privacy Policy

Termination by Us:

• We may suspend or terminate your account for violations of these Terms
• We may terminate your account for prolonged inactivity
• We reserve the right to terminate any account without notice for serious violations

Effects of Termination:

• Upon termination, your right to use the service stops immediately
• We may delete your data after termination as described in our Privacy Policy
• Terms that by their nature should survive termination will survive

Governing Law:

• These Terms are governed by the laws of the Islamic Republic of Iran
• The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded

Dispute Resolution:

• Any disputes will first be attempted to be resolved through good-faith negotiations
• If negotiations fail, disputes shall be resolved through arbitration
• The arbitration shall take place in Tehran, Iran

Class Action Waiver:

• You agree to resolve disputes with us on an individual basis
• You waive any right to participate in a class action lawsuit or class-wide arbitration
